Copyrights: reward for creative effort
Copyrights Law protect original works which are the result of a creative effort of their author. It is important to bear in mind that convrights law do not protect ideas but the expression or the same.
Both European and Spanish laws contain an exemplary list of works that are protectable under this figure, such as literary, artistic or scientific works expressed in an medium, such as books, writings, musical compositions, dramatic works, choreographies, audiovisual works,sculptures, pictorial works, plans, models, maps, photographs…
In addition. the legislator has added to this list computer programs and databases that receive a specific legal treatment.
It is necessary to emphasize that the works mentioned above are not the only ones that maybe eligible for copyrights protection. Currently, there are other types of works such as multimedia works, web page interfaces or applications, video games, blog entries, audio books and a long etcetera that are also entitled to the protection provided by the Intellectual Property law
2 types of rights: moral and economic
Copyright protects two types of rights. On the one hand, economic rights, which allow owners to obtain financial reward for the use of their works by others; and on the other hand, moral rights, which allow authors to take certain actions to preserve and protect their personal link to their work.
Copyrights Transfer
The author, as the initial owner and holder, can transter his or her economic rights to third parties. This usually occurs through licensing agreements, whether exclusive or non-exclusive, assignments or inheritances. Copvrights law enables authors to control how others use their works, and to receive remuneration for that use.
When are copyright obtained?
Copyrights exist from the very moment the work is created. However, it is advisable to register or legally deposit the work in the Intellectual Property register or any other appropriate means for evidentiary purposes.
Related or Neighboring Rights
In addition to copyrights, there are also the so called related or neighbouring rights, which are those granted to performers (musicians, singers, actors, orchestra conductors, dancers, etc.), sound producers and audiovisual recordings’ producers and to broadcasting entities.
2 tipos de Derechos: morales y económicos
Los derechos de autor implican derechos económicos o patrimoniales, que permiten a sus titulares obtener una recompensa económica por la explotación de sus obras y, derechos morales, que permiten a sus autores realizar determinadas acciones para preservar y proteger su vínculo con la obra.
Transferencia de Derechos
El autor, como propietario y titular inicial, puede transferir sus derechos, al menos los económicos, a terceros; esto suele ocurrir mediante acuerdos de licencia, ya sean exclusivos o no exclusivos, cesiones o herencias. Gracias a los derechos de autor, los autores pueden controlar la forma en que otros utilizan sus obras, y recibir una remuneración por ese uso.
¿Cuándo se adquieren los Derechos de Autor?
Los derechos de autor se adquieren en el mismo momento de creación de la obra. Sin embargo, es conveniente realizar la inscripción o el depósito legal en el Registro de la Propiedad Intelectual o en cualquier otro medio adecuado para disponer de un medio de prueba que acredite formalmente, frente a terceros, la existencia de la obra y la titularidad de los derechos.
Derechos Conexos o Vecinos
Además de los derechos de autor, existen también los derechos conexos o vecinos que son los concedidos a los artistas intérpretes y ejecutantes (músicos, cantantes, actores, directores de orquesta, bailarines, etc.), a los productores de grabaciones sonoras y audiovisuales, y a las entidades de radiodifusión.
